These Terms of Use ("Terms") are a legal agreement between you and Homely ("Homely", "we", "us", "our") governing your access to and use of:
- the Homely mobile application;
- the Homely website and related pages; and
- all related services, features, and content (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction. If you use the Services on behalf of a company or entity, you represent that you have authority to bind that entity.
2. Service Description
Homely provides AI-powered interior and home transformation features, including image processing, generation, and related tools.
We may modify, suspend, or discontinue any feature at any time.
3. Accounts, Access, and Security
You are responsible for activity that occurs under your device/session access.
You agree to use the Services lawfully and to keep your device and account access secure.
4. User Content
"User Content" means content you upload, submit, or generate through the Services, including images, masks, prompts, and outputs.
4.1 Ownership
As between you and Homely, you retain ownership of your User Content, subject to the rights you grant below and third-party rights.
4.2 License to Homely
You grant Homely a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and transmit User Content solely to:
- provide and operate the Services;
- improve reliability, security, and quality;
- comply with legal obligations.
5. Prohibited Conduct
You agree not to:
- violate any applicable law or regulation;
- upload content you do not have rights to use;
- infringe privacy, intellectual property, or other rights;
- reverse engineer, disrupt, or interfere with the Services;
- bypass limits, abuse credits/subscriptions, or attempt unauthorized access;
- use the Services for harmful, unlawful, deceptive, or abusive purposes.
We may remove content or suspend access for violations.
6. AI Output Notice
AI-generated outputs may be inaccurate, incomplete, or unsuitable for your intended purpose. You are responsible for reviewing outputs before relying on them.
Homely does not guarantee that outputs are unique, error-free, or fit for any specific purpose.
7. Subscriptions, Credits, Billing, and Refunds
7.1 Purchases
Paid features, subscriptions, and credits may be offered through Apple App Store, Google Play, or other authorized billing channels.
7.2 Auto-renewal
Subscriptions may auto-renew unless canceled before renewal through your store account settings.
7.3 Credits
Credits may be required for certain actions. Credits and entitlements are non-transferable and have no cash value unless required by law.
7.4 Refunds
Refund policies are subject to the billing platform's rules and applicable law.
8. Intellectual Property
The Services, including software, design, trademarks, logos, and content (excluding your User Content), are owned by Homely or its licensors and protected by intellectual property laws.
No rights are granted except as explicitly stated in these Terms.
9. Third-Party Services
The Services may integrate or link to third-party services. Homely is not responsible for third-party products, content, or policies.
10. Termination
We may suspend or terminate access immediately if:
- you violate these Terms;
- required by law; or
- needed to protect security, users, or the Services.
You may stop using the Services at any time.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMELY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMELY'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO HOMELY FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Homely and its affiliates from claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Turkiye, without regard to conflict-of-law principles.
You agree that courts located in Istanbul, Turkiye will have exclusive jurisdiction over disputes arising out of or related to these Terms or the Services, unless applicable consumer law provides otherwise.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide notice where required.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
